It provides you with an opportunity to promote your products and services, communicate with current and potential customers and immediately establishes credibility. However, as with every mode of communication, there are liability risks. Here are some of the most common risks and steps to take to avoid them.

Defamation if the #1 risk for a website. This would include false or disparaging statements about people, businesses or their products. Your products or services may be better than your competitors, but unless you have indisputable proof of that, avoid posting these statements on your website.

Copyright infringement can get you in trouble. Did you find a great article or photo that you posted on your website? If you didn’t have permission to do so, you are at risk for a lawsuit. Before posting anything that you haven’t written yourself, make sure you get permission from the author or photographer.

Trademark infringement is another concern. Make sure you have written permission from suppliers, distributors, etc. to post their names, web addresses or logos on your site.

Be very careful about using personal, private information. You may want to feature testimonials from customers, but make sure you get their permission first. Also, be cautious about posting photos of other businesses or people’s homes without their knowledge or consent.

Questions or concerns about your insurance coverage? How many of your clients are properly insured in the case of a flood? Let our department help you determine for your clients whether they are covered properly in the case of a claim. Our department is able to place flood insurance through the Federal flood program and excess flood coverage with several of our excess carriers.

The maximum coverage through the Federal flood program is $250,000. If the replacement cost of the home exceeds this amount, the property may not be fully covered in the case of a loss. However, an excess flood policy can be purchased to insure the home up to the full replacement cost. This policy would cover any loss over the $250,000 offered through the standard flood company up to the replacement cost of your home.

For example, if the replacement cost of your home is $400,000, the standard flood policy would have the maximum limit of 250,000. The excess flood policy would then provide coverage of $150,000 to equal the full replacement cost of $400,000.

If you have any questions or would like a quote for this coverage please contact any one of our knowledgeable personal lines customer service representatives.

Insuring Children in College

Are your kids graduating college or maybe starting college in the Fall? Although our agency writes both policies, we try only to sell Standard Policies due to the limitation of coverages with Basic policies. The Standard Policy includes the following coverages:

Bodily Injury Liability Coverage pays for claims and lawsuits by people who are injured or die as a result of an auto accident you cause. It compensates others for pain, suffering and economic damages such as lost wages.

Property Damage Liability Coverage pays for claims and lawsuits by people whose property is damaged as result of an auto accident you cause.

Uninsured Motorist Coverage pays you for property damage or bodily injury if you are in an auto accident caused by an uninsured driver.

Underinsured Motorist Coverage pays you for property damage or bodily injury if you are in an auto accident caused by a driver who is insured, but who has less coverage than your underinsured motorist coverage.

Collision Coverage pays for damage to your vehicle as the result of a collision with another car or other object.

Comprehensive Coverage pays for damage to your vehicle that is not a result of a collision, such as theft of you car, vandalism, flooding, fire or a broken windshield. However, it will pay if you collide with an animal.

Personal Injury Protection (otherwise known as PIP). This is your medical coverage for injuries you (and others) suffer in an auto accident. It is sometimes called “no fault” coverage because it pays your own medical expenses no matter who caused the accident. PIP has two parts (1) coverage for the cost of treatment you receive from hospitals, doctors and other medical providers and any medical equipment that may be needed to treat your injuries and (2) reimbursement for certain other expenses you may have because you are hurt, such as lost wages and the need to hire someone to take care of your home or family.

Bodily Injury, Liability/Property Damage and Uninsured/Underinsured coverage and PIP are required coverages by the state of New Jersey.

Elected coverages that can be added to the policy are Comprehensive, Collision, Rental Reimbursement and Towing and Labor.

Check with your agent to make sure you have the most comprehensive coverage for your automobile.

In addition, most companies offer package discounts when both auto & home is written with the same company.

Courtesy of Theresa Butler - Personal Insurance Department

Holiday Safety Tips

More than 50% of adults plan to hang holiday lights this year, according to the safety council. Insurance companies cannot cancel a policy that has been in force for more than 60 days except when:You do not pay the premium. You have committed fraud or made serious misrepresentations on your application.

Non-renewal is a different matter. Either you or your insurance company can decide not to renew the policy when it expires. Depending on the state you live in, your insurance company must give you a certain number of days' notice and explain the reason for not renewing before it drops your policy. If you think the reason is unfair or want a further explanation, call either the insurance company or your agent. If you're not happy with the explanation, you can contact your states Department of Insurance and file a complaint.

The company may have decided to drop that particular line of insurance or to write fewer policies in the area you live, so the non-renewal decision may not be because of something you did. On the other hand, if you did do something that raised the insurance company's risk considerably, like committing fraud or not complying with company recommendations or requirements, the premium may rise or you may not have your policy renewed.
If your insurance company did not renew your policy, you will not necessarily be charged a higher premium at another insurance company.

If you receive either a notice of non-renewal or cancellation be sure to call your agent right away. These are not issues you want to let slip through the cracks.

Courtesy of Sara Richards - Personal Insurance Service Center

Animal Liability

Did you know that Fido can affect your insurance?

For pet owners, especially dog lovers, man's best friend can be a liability risk for you and your insurance company. Most companies have restrictions against certain breeds, what they call vicious breeds' or breeds on the 'bad dog list'.

Some are obvious, for example, Pit Bulls, Rottweilers, and German Shepards are the top three breeds responsible for the greatest number of dog-bite-related fatalities. But other dogs may not be as obvious. For instance, a Saint Bernard, or a Great Dane may seem mild, but in fact are on this top ten list. So, as a homeowner, if you're looking to purchase a new pet, keep some things in mind:

Some insurers may charge higher premiums for certain breeds of dogs.

Consult with a professional (e.g., veterinarian, a responsible breeder) to find a suitable breed of dogs for your household.

Spend time with a dog before buying or adopting it. Use caution when bringing a dog into the home of an
infant or toddler.

Consider spaying/neutering your dog (this can reduce
aggressive tendencies).

Do not play aggressive games with your dog.

Properly socialize and train any dog entering the household.

Immediately seek professional advice if the dog starts exhibiting aggressive or undesirable
behaviors.

And finally, advise your insurance representative when you do purchase a dog. Most insurance companies inspect the homes they insure, so thinking, "they'll never find out about my dog" is a bad idea. Be safe about your pet.

Courtesy of Sara Richards - Personal Insurance Department

Personal Umbrella Liability Insurance

Did you know that dollar for dollar, personal liability insurance is the most economical insurance available in todays market place?

Personal liability provides for damages that you are legally liable for. This includes incidents occurring at your home and/or caused by you, residents of your household or your pets. Here are some common examples: your dog bites someone, a guest falls down your front steps, someone gets hurt in your swimming pool, your child accidentally injures another child.

Whether at home, vacationing in another state or in another country, it provides coverage for personal liability losses, defense cost and even loss of income.

A lawsuit can be devastating emotionally and financially. If a judgment against you exceeds the liability coverage of your auto or homeowners insurance your personal assets can be seized. Umbrella insurance can help protect what you've worked a lifetime to build.

Consider the following factors of an umbrella policy: The value of the current assets you need to protect. Do you have a swimming pool? Are you involved in activities that put you at a greater risk? Do you have teenagers?

If you are interested in an Umbrella quote, come see us in the Personal Insurance Dept!

Courtesy of Barbara Ordille - Personal Insurance Department

Saving Money on Auto Insurance

There are many factors that go into determining auto rates, many of which are beyond our control. However, there are things you can do to save money on auto insurance costs.

1. Drive Safely- most insurers offer the lowest rates to drivers with good driving records.

2. Deductibles- Choosing a higher deductible can mean paying less for your policy. Consider the rising cost of repairs and what you can afford to pay out of your own pocket.

3. Safer cars benefit - a car that is practical, safe to drive and inexpensive to repair will cost less to insure. High performance cars, expensive cars (costly repairs) and cars that are likely to be stolen will cost more to insure.

4. Eliminate unnecessary coverage- If you drive an older car with little cash value, consider eliminating collision or comprehensive coverage.

6. Money saving discounts- some common discounts insurers offer are anti-lock break credit, anti-theft credit (alarms, passive disabling device, keyless devices), defensive driver credit (state approved defensive driver accident prevention course), driver training credit (under 21 yrs old), good student credit, low mileage credit (lower miles on road, lowered risk of accident), multi car credit.

Packaging your insurance policies (Auto & Home) can also save you money!

Courtesy of Marni Jurgens - Personal Insurance Department

Bi-Weekly Mortgage Payments

Did you know that at any time throughout your loan you can call customer service and sign up to pay your mortgage bi-weekly? You can request them to split your total payment in half and you pay that amount every other week. This is helpful for people who would rather pay the smaller amount then have to pay the total all at once. Also, when paying bi-weekly you are actually making one extra payment per year which will pay off a 30 year loan about 7 years early. But what exactly does that mean? Typically, mortgage companies charge you an origination fee, commitment fee, discount points, appraisal fee, credit report fee and a processing fee. These can add up to almost $2,000. When we say that we have no fees, we mean that there are no fees! The only closing costs that you pay are for your closing agent, title insurance and monthly escrows for your taxes and insurance. We do not charge our customers anything to process the mortgage.

It seems that other mortgage companies have jumped on this idea and are also offering loans like this, but beware! Their idea of “no fees” or “low fees” is different than ours. For example, we recently had a customer who was working with one of our realtors. This customer came to us for a quote on the rates and closing costs. They decided to shop around and ended up going with another company who promised lower closing costs. The other company was going to pay for the title insurance which is something that we do not offer. As it turns out, that customer ended up paying over $1,000 more than what we had quoted to do the same loan. That is because most companies pick one item such as title insurance and don’t charge for that, but make up for it in other places. Insurance companies can fail or cease to operate due to inadequate financial capabilities, competitive forces, or changing fundamentals in their marketplaces.
The Commercial Insurance Department has access to several well known insurance company rating organizations, most notably “A.M. They may discover that they are underinsured AFTER a loss occurs. A small business owner could then be forced to go out of business because of a costly uninsured accident. Credit scores can now be used in determining Insurance Rates.

Check for and correct errors in your credit report. Mistakes happen, and you could be paying for someone else’s poor financial management.

Pay down credit card bills. If possible, pay off the entire balance every month. However, transferring credit card debt from one card to another could lower your score.

Don’t charge your credit cards to the maximum limit.

Wait 12 months after credit difficulties to apply for a mortgage. You’re penalized less for problems after a year.

Don’t purchase big-ticket items for your new home on credit cards until after the loan is approved. The amounts will add to your debt.

Don’t open new credit card accounts before applying for a mortgage. Having too much available credit can lower your score.

Shop for mortgage rates all at once. Too many credit applications can lower your score, but multiple inquiries from the same type of lender are counted as one inquiry if submitted over a short period of time.

Avoid finance companies. Even if you pay the loan on time, the interest is high and it will probably be considered a sign of poor credit management.

Real Estate Tips

With Real Estate moving as fast as it is in many parts of the country, it can be overwhelming deciding if this is the right time to jump in.
